Notice of Public Hearing- Proposed Local Law No.C-2024 “A Local Law to Amend Chapter 235 of the Code of the Town of Marcellus Regarding Outdoor Concerts”
NOTICE OF PUBLIC HEARING
TOWN OF MARCELLUS
NOTICE IS HEREBY GIVEN that, pursuant to Municipal Home Rule there has been presented to the Town Board of the Town of Marcellus, New York, at a regular meeting thereof held on November 6, 2024, proposed Local Law No. C-2024, titled, “A Local Law to Amend Chapter 235 of the Code of the Town of Marcellus Regarding Outdoor Concerts,” and following, changes were made thereto and a second version of Local Law No. C-2024 was re-introduced at a regular meeting of the Town Board of the Town of Marcellus on January 8, 2025. Said Local Law, if enacted, will amend certain provisions of the Code of the Town of to allow outdoor concerts subject to the receipt of a special permit for the same. The full text of said Local Law is on file at the Town Clerk’s Office at the Town Hall located at 22 East Main Street, Marcellus for inspection by all interested persons.
NOTICE IS FURTHER GIVEN that a public hearing on the issue of proposed Local Law No. C-2024 was noticed for and held on December 4, 2024 and publication of the Notice of Public Hearing was accomplished as per law; however, given the changes made to Local Law No. C-2024 subsequent to the December 4, 2024 public hearing, the Town Board is scheduling and noticing a new public hearing for proposed Local Law No. C-2024.
NOTICE IS FURTHER GIVEN that subsequent to the public hearing held on December 4, 2024, it was determined by the Town Board to revise and amend proposed Local Law No. C-2024, which revisions clarify conditions for receiving a special use permit for outdoor concerts as an accessory use in certain Zoning Districts.
NOTICE IS FURTHER GIVEN that a revised and amended version of proposed Local Law No. C-2024 was presented to the Town Board of the Town of Marcellus, at a regular meeting thereof held on January 8, 2025.
NOTICE IS FURTHER GIVEN that on January 8, 2025, the Town Board determined that this proposed Local Law is Type I Action pursuant to the State Environmental Quality Review Act and a Negative Declaration was adopted at that time.
NOTICE IS FURTHER GIVEN that the full text of said Local Law, as revised and amended, is on file at the Town Clerk’s Office at the Town Hall located at 22 East Main Street, Marcellus, New York, for inspection by all interested persons.
NOTICE IS FURTHER GIVEN that the Town Board will hold a public hearing on the proposed Local Law, as revised and amended, at the Town of Marcellus Town Hall located at 22 East Main Street, Marcellus on February 5, 2025, at 6:30 p.m., or as soon thereafter as the matter can be heard, at which time all persons interested will be heard.
